Legal Advice & Representation

Have you had your licence suspended due to drink driving or driving with an illegal drug in your blood or saliva? Speak with the team at Cairns Traffic Lawyers for assistance in applying for a work licence. We help clients in Cairns and the rest of Queensland.

A restricted work licence allows eligible drink driving/DUI offenders to drive for work when their normal licence is suspended. Work licences have strict criteria, and the magistrate can refuse your application if they deem you unfit.

If you’re eligible, you must apply to the court upon conviction and before the court orders that you’re disqualified from driving. With help from our professionals, you’ll promptly present a case in court saying that you’re fit and proper, and that you’ll lose your job if you don’t receive a work licence, causing a loss of income and extreme hardship for you or your family. Our lawyers can help you prepare for court and will provide advice through all stages.

Are You Eligible for a Work Licence?

To apply for a work licence, you must have been charged with—and you’re going to plead guilty to—drink driving, failing to provide a breath sample or driving with a drug in your blood or saliva.

In addition to this criterion, you can be eligible for a work licence if:

  • You weren’t driving for your job or you weren’t already under a work licence
  • You had a blood alcohol concentration level of less than 0.15 percent
  • You held a current Queensland open driver licence at the time of the offence
  • You haven’t had your licence disqualified, suspended or cancelled in the last five years
  • You haven’t been convicted of drink driving, dangerous driving or a similar offence in the last five years

If you have any questions or concerns, please call us on 07 4041 4370 to book an appointment. We would be more than happy to run you through the criteria.

Who Is Not Eligible for a Work Licence?

Losing your licence for an extended period of time can hinder your lifestyle and working arrangements. However, not everyone can apply for a work licence.

If the following applies to you, then you are not eligible for a work licence:

  • You are unemployed
  • You don’t need a licence for your job or to get to your job (e.g., there is no public transport available)
  • You are not the only driver in your family

Although it is inconvenient for you, the court will not provide a work licence if you don’t need one to sustain an income. Contact us to learn more.
